VoltMost Privacy Policy

This Privacy Policy explains how VoltMost LLC, a Wyoming limited liability company (“VoltMost,” “Company,” “we,” “our,” or “us”), collects, uses, discloses, and protects personal information when you access or use the VoltMost Platform, including our public website, Customer mobile application, Provider portal, dispatcher dashboard, Operator mobile application, customer support functionality, and related products and services (collectively, the “Platform”).

VoltMost operates an online technology marketplace that connects Customers seeking roadside assistance with independent Providers and their authorized personnel. VoltMost is only a technology company. VoltMost is not a towing company, roadside assistance company, repair facility, locksmith, fuel delivery company, transportation carrier, emergency responder, or employer of Providers or Operators, and does not perform Roadside Assistance Services. This Privacy Policy should be read together with the VoltMost Terms of Service (the “Terms”), which govern your use of the Platform. Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms.

1. Scope and Application

This Privacy Policy applies to personal information we process about Users of the Platform, including Customers, Providers, Operators, Dispatchers, provider administrators, visitors to our website, and prospective Providers who submit onboarding information. It applies across the Platform’s public website, mobile applications, provider and dispatcher interfaces, payment and dispatch functionality, and customer support channels.

This Privacy Policy does not apply to the independent business practices of Providers, or to third-party websites, applications, or services that maintain their own privacy practices, as described in Section 13 (Third-Party Services). VoltMost is currently intended for use in the United States, and initially expects to operate in Pennsylvania, New Jersey, and Florida, with possible expansion to other U.S. jurisdictions.

2. Defined Terms

To keep this Privacy Policy consistent with the Terms, we use the same defined terms, including Account, Customer, Provider, Operator, Dispatcher, Platform, Marketplace Services, Roadside Assistance Services, Service Request, User, and Applicable Law. As a reminder:

A Customer is any individual or entity that uses the Platform to request, schedule, pay for, or otherwise obtain roadside assistance or related services.

A Provider is an independent business authorized by VoltMost to receive and fulfill Service Requests through the Platform.

An Operator is an authorized representative of a Provider who performs Roadside Assistance Services on the Provider’s behalf.

A Dispatcher is an authorized representative of a Provider responsible for assigning Operators, coordinating Service Requests, and managing Provider operations through the Platform.

“Applicable Law” means all federal, state, and local laws, regulations, ordinances, rules, judicial decisions, and governmental requirements that apply to the use of the Platform.

“Personal information” means information that identifies, relates to, describes, or could reasonably be linked with a particular individual or household, as defined under Applicable Law.

3. Sources of Information

We collect personal information from three general sources: (a) information you provide directly, such as when you create an Account, submit a Service Request, apply to become a Provider, communicate with us, or provide a payment method; (b) information we collect automatically through your use of the Platform, such as device, location, and usage information; and (c) information we receive from third parties, such as our third-party payment processor, mapping and geolocation providers, Providers regarding their personnel, and other service providers that help operate, secure, analyze, communicate through, and improve the Platform. Each category of information below indicates how it is typically collected.

4. Personal Information We Collect

4.1 Account and Identity Information

When you register for or maintain an Account, we collect information you provide directly, which may include your name, email address, telephone number, login credentials, account identifiers, your User role (for example, Customer, Provider, Operator, or Dispatcher), and profile information. For Provider organizations, this may also include the names and contact information of authorized representatives, Dispatchers, and Operators associated with the Account.

4.2 Customer Information

When you use the Platform as a Customer, we collect information you provide directly and information generated through your use of the Marketplace Services, which may include:

Contact information;

Vehicle details, such as make, model, year, license plate, and related vehicle information;

The requested service type and any notes or description you provide about the vehicle’s condition;

Pickup or service location, and the towing destination where applicable;

Saved locations and service history;

Communications with Providers, Operators, Dispatchers, or VoltMost;

Ratings, reviews, and support requests; and

Payment method information, as described in Section 4.4.

4.3 Provider, Business, and Operator Information

When a Provider applies to participate on the Platform or maintains a Provider Account, the Provider or its authorized representatives may provide:

Authorized representative contact information;

Legal business name;

Business address or base address;

Service area or service radius;

Provider type and the services offered;

Vehicle types supported, including electric vehicle charging equipment details where applicable;

Notes; and

Optional license or certification materials that a Provider chooses to upload.

Operators may use an Operator application or flow to view active or queued tasks, update job status, and share location while online or assigned to active Service Requests, as described in Section 4.5.

Additional verification, licensing, insurance, banking, tax, or payout-related information may be collected only if and when VoltMost enables features that require it, such as Provider payouts. These features are not part of the current Platform, and this Privacy Policy will be updated before any such information is collected for those purposes.

Providers are responsible for ensuring that they have an appropriate basis to share information about their Operators, Dispatchers, and other personnel with VoltMost, and for informing those individuals about how their information is used in connection with the Platform.

4.4 Payment and Transaction Information

Payments on the Platform are handled by a third-party payment processor. When you provide a payment method, the payment processor collects and processes your payment information directly, subject to its own privacy practices and terms. VoltMost does not store complete payment card numbers.

VoltMost may receive from its payment processor limited information needed to operate the Marketplace Services, which may include payment tokens, payment method references, limited card metadata (such as the card brand and last four digits), setup or payment status, receipts, and refund- or dispute-related records where applicable.

VoltMost does not currently process Provider payouts or collect Provider banking or tax information for payout purposes. If VoltMost enables payouts or related features in the future, it will update this Privacy Policy to describe any additional information collected.

4.5 Location Information

Location information is important to how the Platform facilitates roadside assistance, because a Service Request depends on identifying where a vehicle is located and connecting it with a nearby Provider. Depending on your role, your device settings, and the permissions you grant, we may collect and process:

Customer location. When a Customer requests service, the Platform uses foreground, request-based device location to help set the pickup or service location, and the towing destination where applicable. This location is used in connection with a Customer’s Service Request.

Provider and Operator location. An Operator may share location through the Operator application while online or while assigned to an active Service Request, which may include background and precise (GPS-based) location for the duration of active or assigned tasks. Background and precise location collection is scoped to Operators who are online or assigned to active Service Requests and is not collected from Customers generally. A Provider’s business or base address may also be collected as described in Section 4.3.

Other location data. We may also process approximate location (such as location derived from an IP address) and route, distance, arrival, dispatch, and proximity information, along with associated timestamps, in connection with the Marketplace Services.

We use mapping and geolocation service providers to support these features. You control location permissions through your device and application settings and can enable or disable location access, including precise or background location, at any time. Because roadside assistance depends on knowing where a vehicle and an Operator are located, disabling or limiting location access may prevent or limit core Platform functionality, including the ability to create, dispatch, or complete a Service Request.

To facilitate active Service Requests, an Operator’s location may be shared with the requesting Customer, and a Customer’s service location may be shared with the assigned Provider, Operator, and Dispatcher, and with VoltMost, to support dispatch, safety, customer support, and fraud prevention. We retain location information in accordance with Section 7 (Data Retention).

4.6 Device and Technical Information

When you use the Platform, we automatically collect certain device and technical information, which may include:

IP address and general network information;

Device type, operating system, and app version;

Browser type;

Device identifiers;

Push-notification tokens, notification records, and notification preferences;

Language and time zone settings;

Login and authentication events;

Crash reports, logs, and diagnostic information;

Usage events, such as features accessed and actions taken on the Platform; and

Security and fraud signals.

This information is collected through your device, our infrastructure, and third-party service providers that help operate, secure, analyze, and improve the Platform.

4.7 Communications

We keep records of the communications you send through the Platform and to us, which may include emails, in-app messages, support requests, and your notification and consent preferences. We use this information to provide support, operate the Platform, address safety and fraud concerns, resolve disputes, and comply with Applicable Law.

VoltMost does not currently operate telephone- or SMS-based communications or call-recording features as part of the Platform. If VoltMost adds such features in the future, any related collection, recording, or monitoring will occur only where implemented and only as permitted by Applicable Law, and this Privacy Policy will be updated accordingly.

4.8 Cookies and Similar Technologies

We and our service providers use cookies and similar technologies on our website, and local or device storage within our applications, to operate the Platform, keep you signed in, remember your preferences, secure the Platform, and understand how the Platform is used. This section is intended to serve as our cookie and similar-technologies disclosure, so that a separate cookie policy is not required. The technologies we may use include:

Essential and authentication cookies, which are necessary to provide the Platform, keep you logged in, and maintain the security and integrity of your session;

Browser session and local storage, and mobile app local or device storage, which store information on your device to support Platform functionality and remember your choices;

Security tools, which help detect and prevent fraud, abuse, and unauthorized access;

Preference technologies, which remember settings such as language and display preferences;

Analytics and diagnostics technologies, including software development kits (SDKs) in our applications, which help us understand usage and improve the Platform; and

Pixels or advertising technologies, only if and when we later implement them.

Essential technologies are required for the Platform to function and cannot be turned off through our systems, although you may be able to restrict them through your browser or device. Nonessential technologies may require your consent depending on your jurisdiction, and where consent is required, we will seek it in the manner required by Applicable Law. You can manage many cookies through your browser settings and can manage certain identifiers through your device settings. VoltMost does not currently use cookies or similar technologies for cross-context behavioral advertising; if this changes, we will update this Privacy Policy and provide any notice or choice required by Applicable Law.

5. How We Use Personal Information

We use personal information for the purposes described below, consistent with our role as a technology marketplace. We may use information to:

Create, administer, and secure Accounts, and authenticate Users;

Review Provider applications and onboarding information, including any optional license or certification materials a Provider chooses to submit;

Connect Customers with Providers and facilitate the Marketplace Services;

Create, dispatch, manage, and complete Service Requests;

Display Provider or Operator status and location during active Service Requests;

Calculate routes, distances, estimates, and arrival information;

Process Customer payments and, where applicable, refunds and payment disputes;

Send service-related notifications, receipts, account alerts, legal notices, and support communications;

Provide customer and Provider support and respond to your requests;

Investigate and resolve complaints and disputes;

Detect, investigate, and prevent fraud, misuse, account sharing, unsafe activity, and security threats;

Enforce the Terms and any supplemental policies;

Operate, maintain, test, and improve the Platform, and diagnose technical problems;

Comply with Applicable Law, including lawful requests from governmental authorities;

Protect the rights, property, and safety of Users, Providers, VoltMost, and the public; and

Evaluate, negotiate, or complete a business transaction, such as a financing, merger, acquisition, restructuring, or sale, as described in Section 6.

Service-related versus marketing communications. Service-related communications—such as account, transaction, dispatch, safety, and legal notices—are necessary to operate your Account and the Platform, and you cannot opt out of them while you maintain an Account. Marketing communications are different: where we send them, we do so consistent with Applicable Law, and you may opt out of marketing communications at any time without affecting service-related communications.

6. How We Disclose Personal Information

We disclose personal information only as described in this Privacy Policy and as permitted by Applicable Law. We may disclose personal information to:

Customers, Providers, Operators, Dispatchers, and provider administrators, to facilitate Service Requests, communications, safety, payment, and dispute resolution. Customers and Providers receive only the information reasonably necessary for these purposes. For example, a Customer may receive the assigned Provider’s or Operator’s name, relevant contact method, and location during an active Service Request, and a Provider may receive the Customer’s name, relevant contact method, vehicle details, service location, and Service Request information.

Third-party service providers and vendors that help operate, secure, analyze, communicate through, and improve the Platform, including providers of hosting and infrastructure, authentication and data storage, payment processing, mapping and geolocation, communications and notifications, and analytics and security. These service providers are authorized to use personal information only to provide services to VoltMost.

The mobile operating systems and app stores through which our applications are distributed, in connection with delivering and operating those applications.

Professional advisers, such as lawyers, accountants, auditors, and consultants, where reasonably necessary and subject to appropriate confidentiality obligations.

Insurers and financial institutions, in connection with claims, payments, disputes, and risk management, where applicable.

Government agencies, courts, and law enforcement, where we reasonably believe disclosure is required by Applicable Law, legal process, or governmental request, or is necessary to protect rights, property, or safety.

Parties to a business transaction, such as an actual or proposed merger, acquisition, financing, restructuring, bankruptcy, or sale of all or part of our business or assets, subject to appropriate confidentiality protections.

Other parties with your consent or at your direction.

No sale of personal information for money. VoltMost does not sell your personal information for money. Depending on how certain terms are defined under state privacy laws, some routine data flows that support the Platform—such as the use of analytics or similar technologies—could be characterized as a “sale” or “sharing” even where no money is exchanged. VoltMost does not currently use personal information for cross-context behavioral advertising or targeted advertising. If our practices change in a way that would constitute a “sale,” “sharing,” or “targeted advertising” under Applicable Law, we will update this Privacy Policy and provide any notice and opt-out mechanism required by Applicable Law, as further described in Section 10.

7. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

Provide and operate the Platform;

Maintain service and transaction records;

Resolve disputes and respond to complaints;

Detect and prevent fraud and abuse;

Meet legal, regulatory, accounting, and insurance requirements;

Enforce our agreements and protect our legal rights; and

Maintain the security and integrity of the Platform, including backups.

Retention periods depend on the type of information, the purpose for which it was collected, operational needs, the existence of an active dispute or investigation, and legal requirements. When we no longer have a legitimate need to retain personal information, we take reasonable steps to delete it or limit its further use, consistent with our systems and legal obligations. Information may persist for a period in backups or archival systems in the ordinary course.

8. Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or loss. These measures may include access controls, authentication requirements, encryption in transit, logging and monitoring, and the use of reputable infrastructure and service providers. We also limit access to personal information to personnel and service providers who need it to perform their functions.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. We do not represent that the Platform is “fully secure,” “unhackable,” or certified under any particular security standard. You are responsible for maintaining the confidentiality of your login credentials and for the security of your devices, and you should notify us promptly of any suspected unauthorized access to or use of your Account, as described in the Terms.

9. Your Choices and Rights

You have a number of choices about how your personal information is collected and used:

Account information. You can review and update certain Account information through your Account settings, or by contacting us. Keeping your information accurate and current helps us provide the Marketplace Services.

Location permissions. You can enable or disable location access, including precise and background location, through your device and application settings. Disabling location may prevent or limit core Platform functionality.

Push notifications. You can manage push-notification settings through your device settings. Certain service-related messages may still be delivered through other means, such as email, where necessary to operate your Account.

Marketing communications. You may opt out of marketing communications at any time by using the unsubscribe mechanism in the message or by contacting us. Opting out of marketing does not affect service-related communications.

Cookies and similar technologies. You can manage cookies through your browser settings and certain identifiers through your device settings, as described in Section 4.8.

Account deletion. You may request deletion of your Account by contacting VoltMost using the information in Section 16.

Depending on where you live and subject to Applicable Law, you may also have rights to access, correct, delete, obtain a portable copy of, restrict, or object to the processing of your personal information, and to appeal a decision we make about a rights request. Section 10 describes these rights in more detail and explains how to exercise them.

Please note that we may need to retain certain information even after you request deletion of your Account—for example, to complete transactions, resolve disputes, prevent fraud, maintain safety, and comply with legal and operational requirements. In addition, deleting or withholding certain information, or disabling certain permissions, may prevent us from providing some or all of the Marketplace Services.

10. U.S. State Privacy Rights

Residents of U.S. states that have enacted comprehensive privacy laws may have specific rights with respect to their personal information, subject to the requirements, exceptions, and thresholds of the applicable state law. These rights may include:

The right to know about and access the personal information we have collected;

The right to correct inaccurate personal information;

The right to delete personal information;

The right to obtain a portable copy of personal information;

The right to opt out of the “sale” or “sharing” of personal information, or of targeted advertising or certain profiling, where applicable;

The right to limit the use of sensitive personal information, where applicable;

The right to appeal a denial of a privacy request; and

The right not to be discriminated against for exercising your privacy rights.

Not every right applies to every User, and the availability of a particular right depends on your state of residence, statutory thresholds, and the applicable exceptions under Applicable Law. As described in Section 6, VoltMost does not sell personal information for money and does not currently use personal information for cross-context behavioral advertising or targeted advertising; where the law provides a right to opt out of “sale,” “sharing,” or targeted advertising and our practices fall within those definitions, we will honor valid opt-out requests and provide the mechanisms required by Applicable Law. To exercise a right, you may contact us using the information in Section 16; we may need to verify your identity before responding, and where permitted, you may use an authorized agent.

11. Sensitive Personal Information

Some of the information we process may be considered “sensitive” under Applicable Law, including precise geolocation, Account login credentials, and payment-related tokens or limited payment details. We collect and use this information only for purposes reasonably necessary to provide and secure the Platform, facilitate and complete Service Requests, process payments, prevent fraud, protect safety, and comply with Applicable Law. We do not use sensitive personal information to infer characteristics about you for advertising purposes. If VoltMost later introduces features that involve additional categories of sensitive information, this Privacy Policy will be updated.

12. Children

The Platform is not directed to children, and is intended only for persons who meet the eligibility requirements set out in the Terms, which require Users to be adults (at least eighteen (18) years of age or the age of majority in their jurisdiction). The Platform is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take reasonable steps to delete it. If you believe a child has provided us with personal information, please contact us using the information in Section 16.

13. Third-Party Services

The Platform relies on, links to, or interacts with third-party websites, applications, and services, including our third-party payment processor, mapping and geolocation tools, app stores, and other service providers. These third parties maintain their own privacy practices, and their collection and use of information is governed by their own privacy policies and terms, not by this Privacy Policy. We encourage you to review the privacy practices of any third party before providing information to it. While we are not responsible for the privacy practices of third parties, nothing in this Privacy Policy is intended to waive any right or protection that cannot be waived under Applicable Law.

14. International Use and Data Transfers

VoltMost is primarily intended for use in the United States. Personal information we collect may be processed and stored in the United States and in other countries where VoltMost or its service providers operate. These locations may have data protection laws that differ from those of your state or country. Where we transfer personal information, we take steps consistent with Applicable Law to protect it.

This Privacy Policy does not represent that VoltMost complies with the European Union General Data Protection Regulation or any other non-U.S. legal framework. If you access the Platform from outside the United States, you do so on your own initiative, and additional rights may apply to you under the laws of your location.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above and, where required by Applicable Law, provide additional notice of material changes, such as through the Platform or by other appropriate means. Where Applicable Law requires your affirmative consent to a change, we will obtain it before the change applies to you. We encourage you to review this Privacy Policy periodically to stay informed about how we handle personal information.
